Probate law deals with issues of division of estate assets after death. If someone passes away without a will (dies “intestate”) the issue of division of the estate goes to probate court. If a will is contested (a probated will) the matter is ruled upon in probate court. Even if a will is not contested, it may go to probate court, where the court oversees such issues as title transfer of property, naming probate executors and beneficiaries, distribution of assets, etc.
