Deciding who will make financial decisions for you in the event of incapacitation (accident, disability) can be essential for your family’s financial health and wellbeing. After all, you want the right person in charge of your estate for your sake, as well as for those who depend on your financial support.

Choosing financial power of attorney is also a wonderful thing to do for your loved ones in that it can keep them out of stressful probate proceedings. If you become disabled or unable to make decisions, a financial power of attorney makes transferring financial decisions easy and streamlined. Without it, your loved ones may face court hassles as they petition for control of financial matters. Having a financial power of attorney in place lets them make the important decisions they need to make when you cannot.

A financial power of attorney is created when you are well and able, and allows you to continue to manage your financial affairs until or unless you become unable to due to disability. The law also allows you to revoke the financial power of attorney if you wish. The financial power of attorney document can be made “durable” (a durable financial power of attorney) by adding certain language that leaves the document in effect under specified terms.

If you do not choose financial power of attorney and become disabled, the state may assign a conservator, who takes charge of your financial affairs. The fees for the conservatorship may be paid out of your estate. If you have someone that you trust to make good financial decisions, it is generally beneficial to avoid a court-appointed conservatorship by designating financial power of attorney.
